Agreement and Release from Liability

I, ______________________________________________________, [print name], acknowledge that I have voluntarily applied to surf in the 2006 Kids For Clean Water Menehune Surf Contest.

I am aware that surfing is a hazardous activity. I am voluntarily participating in this activity with full knowledge and understanding of the danger involved and hereby assume any and all risks of my injury or death.

As consideration for being permitted to surf in the contest, I hereby agree that I, my assignees, heirs, executors, administrators, guardians, and legal and personal representatives will not make any claim against, sue, or attach the property of the Coronado Surfing Association (a California nonprofit public benefit corporation), any of the contest sponsors or volunteers, or the City of Coronado (collectively, the Releasees) or any of the Releasees’ present or former directors, officers, members, agents, employees, successors, predecessors (including without limitation the Coronado Longboard Surf Club and its officers and members) or affiliates (also collectively, the Releasees) for any damages arising from my participation in the contest, including without limitation any damages caused by the negligence of any of the Releasees.

I expressly waive any rights I may have under California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”

I agree that I will indemnify and hold harmless the Releasees against all claims, demands, causes of action, and lawsuits, including court costs and actual attorney fees, brought by me or prosecuted for my benefit and arising from my participation in the contest or this agreement.

I have carefully read this agreement, fully understand its contents, and enter into it of my own free will. I am aware that this is a release of liability, assumption of risk, and an indemnification agreement between me and the Releasees.
